Welcome to BinauralPure. These Terms of Service ("Terms") govern your access to and use of the BinauralPure website, the binaural beats generator, preset library, community features, and optional donations (collectively, the "Service"), operated by BinauralPure ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has read and accepted these Terms on your behalf. By creating an account, you represent and warrant that the information you provide is accurate and complete.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at admin@binauralpure.com of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any local, state, national, or international law.
  • Attempt to gain unauthorized access to, interfere with, or disrupt the Service, its servers, or the networks connected to it.
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service — including generated audio files for free tier users — for commercial purposes without express written permission.
  • Upload, post, or share in the community any content that is defamatory, obscene, infringing, hateful, or otherwise objectionable.
  • Use automated scripts, bots, or scrapers to access or collect data from the Service.

4. Donations & Premium Access

BinauralPure is supported by voluntary donations. There are no subscriptions and no recurring charges.

  • Core generator: binaural beats, isochronic tones, and bilateral EMDR modes are 100% free, forever, with no account required.
  • Donations: processed securely by Stripe. Donations of any amount are pure support for the project.
  • Premium thank-you perk: donations of $15 or more unlock every premium feature on BinauralPure as a thank-you. Premium access is granted for life and carries no ongoing obligation.

To unlock the premium perk automatically, the email used for the donation must match your BinauralPure account email. If the match fails, contact us with your donation receipt and we will grant access manually.

5. Refund Policy

Donations are refundable within 30 days of the donation date, no questions asked. To request a refund, contact admin@binauralpure.com with your donation receipt. Granting a refund also removes any premium access tied to that donation. Statutory consumer rights under EU and Italian law remain unaffected.

6. Intellectual Property

The Service, including its design, text, graphics, software, preset configurations, and curated frequency collections, is owned by BinauralPure and protected by intellectual property laws. Free-tier generated audio may be used for personal, non-commercial purposes only. Pro-tier downloads are licensed for personal use and may not be redistributed.

7. User-Generated Content & Community

Community presets and any content you submit remain your property. By posting, you grant BinauralPure a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the Service. You represent that you own or have the rights to all content you submit, and that it does not violate these Terms or third-party rights.

8. Medical Disclaimer

The Service provides wellness and informational content only and is not a medical device. It is not intended to diagnose, treat, cure, or prevent any condition. See our Medical Disclaimer for important safety information.

9. Third-Party Links

The Service may contain links to third-party websites for informational purposes only. We are not responsible for the content, products, or practices of any third-party site. BinauralPure does not use affiliate links and does not earn commissions on third-party purchases.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that audio output will produce any specific psychological or physiological effect.

11. Limitation of Liability

To the maximum extent permitted by law, BinauralPure shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice. Upon termination, all licenses granted to you under these Terms will cease. Donations are refundable within 30 days as described in Section 5; beyond that, no refunds except where required by law.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use after the effective date constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of Italy, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Italy.
